1. Services

NOW NWA Marketing provides digital marketing services including, but not limited to:

  • Social Media Management

  • Facebook & Instagram Advertising

  • Google Business Profile Management

  • Short-Form Video & Reels Creation

  • Graphic Design

  • Local SEO

  • Website Design

  • Content Marketing

  • AI-Assisted Content Creation

  • Business Branding

  • Marketing Consulting

Service details are outlined in your selected package or proposal.

2. Client Responsibilities

Clients agree to:

  • Provide accurate business information.

  • Maintain ownership of their social media accounts.

  • Grant administrative access when required.

  • Respond to requests for approvals within a reasonable timeframe.

  • Notify us immediately of password changes or account access issues.

Failure to provide access or requested information may delay services.

3. Social Media Platforms

NOW NWA Marketing works with third-party platforms including Facebook, Instagram, TikTok, LinkedIn, Google Business Profile, YouTube, Pinterest, and others.

Because these platforms are operated by third parties, we cannot guarantee:

  • Platform uptime

  • Algorithm performance

  • Account verification

  • Reach or engagement

  • Account approvals

  • Advertising approval

We are not responsible for outages, platform policy changes, hacked accounts, or suspended accounts beyond our control.

4. Fees & Payment

All services require payment in advance unless otherwise agreed in writing.

Monthly plans automatically renew every 30 days.

Invoices unpaid after seven (7) days may result in suspension of services until payment is received.

5. Refund Policy

Due to the custom nature of marketing services, payments are generally non-refundable once work has begun.

New monthly social media management clients may request a refund within fourteen (14) calendar days only if no content has been published.

Advertising spend paid directly to Meta, Google, TikTok, or other advertising platforms is never refundable through NOW NWA Marketing.

6. Cancellation

Monthly services may be cancelled at any time before the next billing cycle.

No partial refunds are issued for unused portions of a billing period.

Completed work remains billable regardless of cancellation.

7. Marketing Results Disclaimer

Marketing results vary based upon many factors including:

  • Competition

  • Industry

  • Advertising budget

  • Website quality

  • Consumer demand

  • Economic conditions

  • Platform algorithms

NOW NWA Marketing does not guarantee:

  • Sales

  • Leads

  • Rankings

  • Followers

  • Viral content

  • Revenue increases

We provide professional marketing services but cannot guarantee specific outcomes.

8. Client Content

Clients retain ownership of logos, trademarks, photos, videos, and other materials they provide.

Clients represent that they own or have permission to use all submitted content.

NOW NWA Marketing is not responsible for copyright claims arising from client-supplied materials.

9. AI-Generated Content

Some graphics, advertisements, captions, videos, and marketing materials may be created using artificial intelligence tools.

All AI-generated content is reviewed by our team before delivery.

Clients are responsible for reviewing content before publication whenever approval is required.

10. Portfolio Rights

Unless otherwise requested in writing, NOW NWA Marketing may display completed work in its:

  • Portfolio

  • Website

  • Social media

  • Sales presentations

  • Marketing materials

Clients may request removal of portfolio examples at any time.

11. Intellectual Property

Upon full payment, clients receive ownership of final approved deliverables unless otherwise stated in a separate agreement.

NOW NWA Marketing retains ownership of:

  • Internal templates

  • Processes

  • Proprietary systems

  • Marketing workflows

  • Training materials

12. Limitation of Liability

NOW NWA Marketing shall not be liable for indirect, incidental, special, or consequential damages.

Our total liability shall never exceed the amount paid by the client during the previous thirty (30) days.

13. Indemnification

Clients agree to defend and hold harmless NOW NWA Marketing from claims arising from:

  • Client-provided content

  • Trademark violations

  • Copyright claims

  • False advertising claims

  • Illegal business practices

  • Regulatory violations

14. Governing Law

These Terms are governed by the laws of the State of Arkansas.

Any legal dispute shall be resolved in the appropriate state or federal courts located in Arkansas.

15. Changes to These Terms

NOW NWA Marketing may update these Terms of Service at any time.

Continued use of our services constitutes acceptance of the revised Terms.
